Job Description

The Position

This role will lead and support litigation and investigations across the Company’s operations in our Asian affiliates.  The Associate Director will have broad responsibilities in the following areas: (1) Investigations; (2) Litigation; and (3) Employment Law.  The position will report to the Director of Legal Investigations within the Litigation & Investigations team based in Company headquarters in Foster City, California.

The role will manage or support all aspects of assigned Investigations, Litigation, Employment Law matters.  The Associate Director will also serve as an institutionalized “centre of excellence” to continuously review best practices, provide training, and ensure consistency across the Asia Region with respect to local law and practices.  The role will partner with and proactively engage with regional senior leadership, Country Counsel, Country HR Business Partners and Employee Relations to influence and advise on strategic issues and establish strategic plans that improve the Company’s approach to Litigation, Investigations, and Employment Law matters across the region, effectively managing risk to Gilead overall.

The Associate Director will take the lead role on some matters and serve in a supporting/coordinating role on others:

Investigations – Will lead internal and external investigations across the Asia region working collaboratively with Country/Regional Counsel and outside counsel as required.   Investigative areas include compliance with applicable healthcare laws, including those related to promotion within regulatory labelling, healthcare fraud/financial interactions with healthcare professionals, disclosure of healthcare spend, and anti-bribery (e.g. FCPA, UK Bribery Act). Responsible for developing investigation plans, interviewing witnesses, assessing and documenting findings, and recommending and presenting corrective actions to business partners and senior leadership. 

Litigation – Will provide support to Country Counsel in managing litigation and pre-dispute matters across Asia.  Responsible for developing and assessing case strategies, assisting with interviewing fact and expert witnesses, reviewing motions and briefs, and managing external counsel.   

Employment Law – Will also provide support to Country Counsel, Employee Relations, and Human Resources Business Partners in managing employment law matters and compliance with local labor laws across Asia.  Areas of advice and counsel may include hiring and separations, wage and hour regulations or standards, employee benefits such as leaves of absences, cross-functional compliance initiatives, policies, training, and pre-litigation disputes or claims from employees.  

Other Key responsibilities:

  • Maintain close coordination with Legal and HR leadership in the United States, Asia headquarters and each affiliate;
  • Design and implement policies, procedures, workflows and communication plans to be implemented at a local level;
  • Design training plans and conduct training;
  • Interface with Global business conduct/anti-corruption teams to ensure efficient and effective consideration of international activities;
  • Assist with audits of healthcare compliance in Asian affiliates
  • Manage internal and external resources, advancing a positive spirit of partnership and collaboration with internal clients including Legal, Human Resources, Regulatory, Commercial, Medical Affairs, outside counsel, specialist consultants, and Internal Audit.


  • A law degree from a prominent US law school or Asian University.
  • Membership of a U.S. state bar or qualified to practice law in China or Hong Kong.
  • 8+ years combined experience at top-tier law firm and in-house legal department with experience working in a multi-national company with responsibility for US and Asian matters.
  • Deep experience in conducting and managing international litigation and investigations matters.


  • The position will require substantive expertise in litigation and investigations combined with excellent project management skills and sound judgment in managing cases and interacting with internal business clients.
  • This position requires working within a team extensively and accordingly, the ability to work collaboratively and efficiently with others is critical.  Candidates must possess strong interpersonal skills and the ability to work well with a variety of different personalities.
  • High influencing and persuasion skills (proven effectiveness at senior management level).
  • Functional Leadership skills – ability to lead cross-functionally by personality, competence and influence.
  • The successful candidate will be given increasing responsibility.  Accordingly, the Associate Director must competently carry-out and follow through on directives, learn quickly, apply legal analysis in a business context, and work independently to identify issues and goals.
  • Ability to work across geographies and demonstrate intercultural competence in a matrixed environment and ensure alignment to various stakeholders
  • The ability to handle multiple tasks in a fast-paced environment is critical.  The position requires appropriate triaging of a heavy workflow, setting appropriate priorities with clients and delivering results within the reasonable agreed timelines.
  • The candidate must demonstrate ability to think creatively and devise solutions to challenging problems and must exercise mature and reliable judgment.
  • Demonstrated client service orientation; able to recognize and respond quickly and pragmatically to urgent situations and demanding clients.
  • Exceptional and demonstrated written and verbal communication skills.
  • Fluent in English and at least one other East Asian language, preferably Mandarin Chinese.
