Job Description

Specific Responsibilities                         

This individual will serve as a critical member of a regional support team for Gilead’s commercial markets in Asia, including China, Japan, Korea, Taiwan, Hong Kong, Singapore and Malaysia.  The role will be based in Hong Kong and will report to the Associate General Counsel of the Legal and Business Conduct team for Asia.

The individual will have the opportunity to help support the team’s activities in building out the infrastructure (including refinement and roll-out of policies and procedures, support and roll-out of electronic tools and platforms (such as contracts management, events management and eLearning systems) across the region, contract templates, monitoring, and training for Gilead’s Legal and Business Conduct programs in Asia, with coordination with the Legal and Business Conduct teams in the Company’s local affiliates.  The individual will play an important role, in close coordination with regional level teams in other key functions, including Commercial Planning and Operations, Medical, Finance, Regulatory, Public Affairs, and Government Affairs, on various projects designed to help the Company navigate an increasingly complex set of laws, regulations and best practices with operational excellence and a commitment to high standards of integrity and ethics.  The individual will execute tactical implementation of various priorities for the Legal and Business Conduct program in Asia.

Responsibilities will include:
l  Support the build-out of the appropriate regional compliance infrastructure and helping to ensure that it is consistent with government guidance on the elements of an effective compliance program, as well as supporting compliance program implementation within the affiliates and among business partners.  This includes, with input from relevant stakeholders:

  • Conducting periodic risk assessments;
  • Ensuring business conduct policies and procedures are up to date and support efficient operation of compliant business activities;
  • Assist country and regional teams in the administration of quarterly compliance meetings, compliance communications and fostering “tone from the top”;
  • Design and implement training and other guidance materials for employees and business partners in the region;
  • Support the oversight of due diligence of third parties across the region;
  • Support efforts to investigate and remedy potential compliance violations; and
  • Support the alignment, coordination and roll-out of monitoring activities across the region in accordance with headquarters procedures and protocols, including monitoring of interactions with healthcare professionals and institutions, as well as promotional and non-promotional materials and ensuring corrective actions are implemented

l  Help support compliance with applicable laws, including those focused on healthcare fraud/financial interactions with healthcare professionals, government officials and other relevant stakeholders; competition and anti-trust laws, promotion within regulatory labeling; disclosure of healthcare spend, and anti-bribery laws;

l  Evaluate and work with other colleagues to deliver general Legal and Business Conduct advice and support to regional business teams, including Asia Commercial Planning and Operations, and Asia Medical Affairs, in coordination with affiliate-level Legal and Business Conduct teams.  This includes support of drafting, review and negotiation of various types of agreements as well as non-contractual legal documents, such as regional strategic business plans and other plans of action;

l  Work with country and regional Legal and Business Conduct colleagues to support the evaluation of potential Legal and Business Conduct risks and align on the effective management of such risks;

l  Develop and update regional contract templates to be used at the regional level, and adapted for use at the affiliate level, including templates that can be utilized on a self-service basis by the business with appropriate monitoring;

l  Lead the effective roll-out of digital infrastructure initiatives, such as electronic contracts management systems, events and HCP interactions management systems, transparency-related systems, and eLearning systems;

l  Provide support as may be needed and as appropriate to local teams and coordination with colleagues in headquarters and other geographies on a variety of Legal issues, such as competition law, investigations, litigation and intellectual property;

l  Establish effective business partnerships and provide Legal and Business Conduct support with regional teams and stakeholders, including Commercial Planning and Operations, Medical Affairs, Finance, Regulatory, Public Affairs, and Government Affairs, including reviews and advice on proposed activities;

l  Interface with US, European, Access Operations and Emerging Markets colleagues to ensure efficient and effective consideration of international activities; and

l  Other tasks as assigned by line management.

Frequent travel to Gilead affiliates in Asia is required.

Knowledge, Experience and Skills          Proven track record of contributions and professional growth and development in prior roles, including ability to apply judgment to areas outside of core competency.

Proven judgment in working through issues, including those with low to moderate risk to the Company. 

Experience drafting and negotiating a wide range of legal documents, as well as anticipating, identifying and managing legal and compliance risks.

English fluency required and preference for additional language skills.

Must have excellent written and verbal communication skills.

Strong analytical and problem solving skills. Detail-oriented and well-organized.

Team player who can handle shifting priorities, multi- tasking in a deadline oriented environment.

Motivated and willing to learn.

LLB, JD or other relevant professional degree from an internationally recognized university is preferred but not required.

6+ years prior industry experience required, preferably 3+ years of performing similar tasks at a similar company.

Experience dealing with biotech or pharmaceutical issues or industry working experience is required.
