In a recent verdict, a federal judge in the U.S.A. mandated Florida education authorities to permit a trans teacher to use feminine pronouns at school, according to ‘LGBTQ Nation’. Katie Wood and AV Schwandes, a nonbinary teacher, instigated a legal challenge against Florida’s HB 1069, a law signed by Governor Ron DeSantis, which prohibits public school staff from using a student’s preferred pronouns if they do not align with the student’s sex, penalising breaches with job termination or teaching certificate revocation.

After HB 1069’s enactment, Wood, employed at Lennard High School where she had legally changed her name and gender markers, was to discontinue using the title “Miss.” Meanwhile, Schwandes, an instructor at Florida Virtual School, was dismissed post-public revelation of their nonbinary identity and rejection of gendered pronouns.
The teachers advocated against HB 1069 citing contraventions of Title VII, Title IX, and the U.S.A. Constitution’s First and Fourteenth Amendments. Seeking injunctive relief to halt the law's enforcement, the court, led by Judge Mark Walker, granted Wood’s request for a preliminary injunction grounded in the First Amendment, effectively halting HB 1069’s application to her.
Judge Walker’s ruling rebuked Florida's attempt to diminish teachers’ autonomous identity expression in public schools, asserting the Constitution’s protection of individuals’ self-identification without interference. The ruling, while favouring Wood’s claim, denied Schwandes’s parallel allegations based on Title VII and First Amendment grounds, citing an absence of evidence or employment status supporting their grievances.
Walker’s judicial decision primarily focuses on Wood’s case, emphasising the absence of a broader constitutional challenge or substantial evidence necessitating an extended injunction. The temporary restraining order serves to safeguard Wood’s rights during the active litigation process.
