eBay Inc.’s Legal Department is looking for a modern, effective International in-house e-commerce lawyer to join the eBay Classifieds Legal Team, based in Sydney, acting as the Head of Legal to the eBay Classifieds Australian businesses (Gumtree AU, Carsguide and Autotrader AU). The ideal candidate is someone who is passionate about sitting with the business, acting as a true business partner and advising a diverse portfolio of e-commerce sites/products on cutting-edge legal issues. Candidates should have significant experience drafting and negotiating non-routine commercial contracts and advising on innovative products/legal issues for an international technology company. This position will report to the Head of Legal, eBay Classifieds Group Canada/NW Europe/Australia.
Primary accountabilities include:
Sitting with the fast-paced eBay Classifieds Group business teams and acting as their real-time legal advisor – attending management team and regional/country team meetings, guiding business strategy, while also doing their operational legal work (contracts, product counselling, marketing reviews, customer policies, instructing counsel regionally, handling disputes etc.);
Working with business stakeholders to understand, structure, negotiate and close complex commercial agreements;
Carrying out product review on the Australian teams’ web and mobile sites/apps;
Carrying out marketing reviews on customer-facing assets (including emails, push notifications and social media activity);
Together with the eBay Classifieds Legal Team, providing support to other eBay Classifieds sites/apps globally;
Drafting and negotiating commercial contracts for partnerships, marketing, PR, technology and other services;
Possible M&A integration support;
Independently coordinating with functional stakeholders, including Tax, Privacy, Information Security, Litigation, IP, and other internal teams;
Working closely with Government Relations (internal and external agency) to consider the impact of upcoming legislation, government proposals, and regulator activity on the business, and assisting with any necessary actions (e.g. submissions, policy changes, industry events);
Working with PR and Government Relations to proactively build relationships with key external stakeholders (including regulators, industry bodies, government);
Resolving any disputes, including by working with Customer Service, the Motors Team, and PR to manage customer escalations;
Working closely with HR on people-related matters;
Managing company secretary requirements, including written resolutions and director responsibilities; and
Managing external counsel regionally, as necessary.
Be qualified to practice law in Australia – any other additional jurisdictions (UK, USA, CAN) would be highly beneficial;
Have 7+ years of strong experience in international e-commerce law, IT, IP, employment, privacy and/or international business transactions, drafting and negotiating complex commercial contracts;
Have strong product review skills and attention to detail - ability to project manage the legal review and updating of a number of international websites/apps and the regular rollout of new products/functionality - working in cooperation with internal legal and product development stakeholders and external counsel in multiple jurisdictions;
Have great business rapport building skills and strong business acumen - this is an entrepreneurial business and we need a lawyer who can build strong relationships quickly and who has the confidence to advise in real time (including remotely, as applicable). Adding value through commercial awareness, risk assessment and industry experience is part of the role; and
Be resilient in the face of change. This is a fast-paced business currently going through a change of ownership (subject to regulatory approval).
Our ideal candidate will:
Have major ecommerce brand in-house legal experience;
Have international e-commerce business experience;
Be familiar with Australian privacy laws and the GDPR;
Have an understanding of ad tech and changes to the advertising landscape;
Be flexible with the scope and variety of projects to be undertaken in this role (including relating to the support of eBay Classifieds business units outside of Australia);
Be comfortable with ambiguity, change and a fast-paced culture, and have a practical, solutions-oriented focus;
Have legal budget management experience – accruals; law firm management;
Have people management experience; and
LLM in IT/IP/E-commerce law a plus.
