Indiana trans teen sues school district to use correct bathroom


A 17-year-old transgender student is seeking a preliminary injunction so that he can use the male bathroom in his high school in Indiana. The student is also in an ongoing legal battle with the school district, according to the Evansville Courier & Press.

The student, identified as J.A.W., sued his school back in February, arguing that his 14th Amendment and Title IX rights were being restricted because he was forced to use the women’s restroom. A judge ruled his lawsuit was justified despite the case being challenged in court. He has been allowed to continue his fight and seek an injunction before he starts his senior year of school on August 8.

Superintendent David Smith testified in court that J.A.W. would only be able to use the correct restroom if he obtained legal documents confirming his gender, otherwise “subjective rule… would result in chaos.”

The judge has yet to make his decision on the injunction.
