Same-Sex Marriage Legalization In Cayman Islands Has Been Overturned
Although same-sex marriage was legalized in March in the Cayman Islands, the government has successfully appealed against this ruling. Chief Justice Antony Smellie has stated at the time of the appeal that a ban in same-sex marriage was unconstitutional, according to ‘Gay Times’.
Back in August, when the appeal launched the country’s premier, Alden McLoughlin said: “I and my entire government have great respect for the chief justice and indeed the independence of the judiciary.
“But even the best judges get it wrong from time to time. Hard cases make bad law. None of us who are human are infallible.
“As premier I will state what I have said many times before – I have no doubt that the feelings of the majority of Caymanians are that marriage should retain its traditional and religious definition and meaning, the union of one man and one woman.”
In a statement following the ruling, lawyer and LGBT+ activist Leonardo Raznovich said: “It is a sad day for Caymanians because their constitution has not been properly upheld by their own courts, and for this reason a sad day for the jurisdiction and its future.”
With this ruling, the Cayman Islands have become the second country in the world to ban same-sex marriages, after Bermuda. However, Bermuda overturned the ban.
