Trans Man Fights to Be Listed As Father On Baby’s Birth Certificate



A trans man is fighting to be listed as the father on his baby’s birth certificate, after having given birth to her, reports The Independent.

 

Upon giving birth the unnamed trans man was told by the registrar he could not listed as either the father or a parent, but that that anyone who gave had to be listed as the mother by law.

 

He has since launched a campaign for the law to be changed, insisting that to be listed as the mother infringes on his right to respect for his private and family life.

 

The President of the Family Division of the High Court, Sir Andrew McFarlane, is set to rule on the case. If the case is successful it will result in a change of law.

 

“It is an accepted fact that a female who transitions to male may in law maintain the ability to conceive and give birth to a child,” said the trans man’s barrister Hannah Markham QC.

 

“It is further averred that the current law relating to the registration of births and deaths is no longer compatible with the changes in society, the evolvement of freedom of expression and gender equality and the protection of an individual’s rights to identify as a particular gender.”
